These Terms and Conditions ("Terms") govern your access to and use of the SailRx website and services provided by SailRx LLC ("we," "our," or "us"). By accessing or using our site and services, you agree to these Terms and our Privacy Policy.

Eligibility

The minimum age to use our Site is 18 years old. By using this Site, you represent that you are at least 18 years old. We are not liable for misrepresentation of age.

Medical Disclaimer

SailRx provides telehealth services, including access to licensed healthcare professionals. Prescription medication is provided only if approved by a licensed provider. We do not guarantee treatment or prescriptions.

No Guarantee of Results

SailRx does not guarantee specific results, including weight loss. Individual outcomes may vary based on numerous factors, including adherence, biology, and lifestyle.

Subscriptions and Payments

Many SailRx programs operate on a subscription basis with automatic renewal. By enrolling, you agree to recurring charges via the payment method provided. Cancellations must be submitted at least 14 days before your next billing cycle. A two-month minimum commitment may apply.

Payments

are due at time of order via the SailRx Portal. Credit or debit cards are the primary method of accepted payment. By submitting your payment details, you authorize SailRx LLC to process charges accordingly.

EXCEPT AS OTHERWISE SET FORTH IN ANY RETURN OR REFUND POLICY PROVIDED TO YOU ON THE SERVICES, YOU ACKNOWLEDGE AND AGREE THAT DUE TO THE NATURE OF THE PRODUCTS AND SERVICES PURCHASABLE THROUGH THE SERVICES, ANY APPLICABLE FEES AND OTHER CHARGES ARE NOT REFUNDABLE IN WHOLE OR IN PART. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR ACCOUNT, INCLUDING ANY UNAUTHORIZED CHARGES.

Appointment and Cancellation Policy You must cancel appointments at least 24 hours in advance. Missed or late cancellations may result in a $25 fee or forfeited service.

Account and Portal Access

You are responsible for maintaining the confidentiality, security, and accuracy of your account information, including login credentials and any personal or medical data. You must promptly notify SailRx of any unauthorized access or suspected breach of your account.

SailRx reserves the right to suspend or terminate your account or access to the Site and Services at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other lawful reason.

Acceptable Use You agree not to:

• Violate any applicable law;
• Misuse any content or functionality;
• Infringe intellectual property rights;
• Harass, defraud, or exploit others;
• Transmit offensive or harmful content.

Violation may result in account suspension and legal action.

Sale of Services Services offered via SailRx include telehealth care, medications, and health-related products. Descriptions are accurate to the best of our ability, but not contractually binding. SailRx may modify or cancel orders as needed. You accept the inherent risk in relying on any site materials.

Refund and Financial Policies Unless stated otherwise, payments are non-refundable once a service is rendered or a shipment is made. You agree that prescriptions are not guaranteed, and plan participation can be suspended or terminated by SailRx at its discretion.

You are responsible for any default balance, interest, and legal or collection costs incurred.

Consumer Protection Law

Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and the applicable legislation, the mandatory provisions of the legislation will apply.

Intellectual Property All site content—including images, graphics, logos, text, and functionality—is owned by SailRx LLC or licensed partners. You may not copy, distribute, or alter any materials without written consent.

Limitation of Liability

To the fullest extent permitted by law, SailRx LLC and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising out of your use of the Site or Services. In no event shall SailRx LLC be liable to you for damages in excess of (1) the amount you actually paid for goods and services via the Site in any 12-month period, or (2) $10,000, whichever is lower.

Indemnity

Except where prohibited by law, by using this Site you agree to indemnify and hold harmless SailRx LLC and its directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of our Site or your violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona. Any dispute relating to or arising from these Terms or your use of the Services shall be resolved exclusively in the state courts located in Maricopa County, Arizona, without regard to conflict of law principles. The prevailing party in any such litigation shall be entitled to recover its reasonable attorney's fees and costs.

You acknowledge and agree that you will not participate in any multi-plaintiff or class actions with regard to these Terms, and instead agree to resolve disputes individually as described above.

Availability of Medications

Due to availability or supply chain issues, SailRx and its partner pharmacies may not be able to source or dispense certain brand-name medications. In such cases, we will work with you to explore available alternatives.

Severability If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be deemed severed and the remaining provisions shall remain in full force and effect.

Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting. Your continued use of the Site and Services following any updates constitutes your agreement to the revised Terms. If you do not agree to the updated Terms, you must stop using the Site and Services.
